1. Introduction
These terms and conditions (“Terms”) govern the use of the website and online store at www.tiga243.com (the “Site”), define the rights and obligations of users/customers and the Site operator, and regulate the contractual relationship between the seller and the buyer.
They are drafted in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), and the Electronic Communications Act (ZEKom-1).
The Terms in force on the date of using the Site or placing an order apply to every user. Before submitting an order, the buyer is alerted to these Terms and must confirm they have read and accept them.

The Operator is registered under activity code 47.710 (retail of clothing) and authorized for mail-order and online sales.
2. Conditions of Use
By accessing the Site or placing an order, the user agrees to these Terms. If they do not agree, they should not use the Site or make a purchase. The Operator reserves the right to modify the Terms at any time; the version published at the time of use or order placement applies.
Browsing and reading content is permitted for personal use only. No element of the Site may be used for commercial purposes, copied into databases, or re-published elsewhere without the Operator’s written consent.
3. Site Content
The Site is intended to:
- Present the Operator, their achievements, career, and sponsors
- Showcase the motorcycle and equipment used
- Offer and sell the Operator’s merchandise
- Provide information on payment methods and contact details
- Publish news, promotions, events, and links to social media
4. Types of Users
Guest: may view all informational content.
Registered User: signs up by providing name, phone, and email; chooses a username and receives a password by email. The password is confidential.
Both guests and registered users can place orders.
To change any personal data, the user must email shop@tiga243.com. Changes will be confirmed by email within one business day.
Personal data collected are used solely to process orders. Any other use (e.g., marketing) requires the user’s explicit consent. Data retention and user rights are detailed in our Privacy Policy.
5. Privacy & Data Protection
The Operator commits to safeguarding personal data in compliance with ZVOP-1, the EU General Data Protection Regulation (GDPR), and other applicable laws.
Purposes of data processing:
- Contacting the user to fulfill orders or clarify details
- Delivery of goods
- Issuing invoices
- Maintaining wish lists on user profiles
- Handling warranty claims
Additional processing (only with user’s written consent):
- Profiling for tailored offers via email, SMS, phone, or mail
- Direct marketing of goods, promotions, and benefits
- Notifications of updates, market research on product quality, and additional services
Data are kept only as long as necessary for the stated purposes or to meet statutory retention periods. Consent-based data are held until the user withdraws consent. A detailed cookie and privacy policy is published on the Site.
6. Operator’s Rights & Obligations
The Operator shall always provide the user with:
- The company’s identity and contact details
- Up-to-date product information (availability, key features, delivery terms)
- Clear pricing (including whether VAT is included and any delivery charges)
- Validity period of promotional offers
- Payment and delivery methods
- Instructions on the right of withdrawal (per Art. 43 ZVPot) and complaint procedures
The Operator does not guarantee the accuracy of external links and is not liable for third-party content. The Operator may contact users only if they have given consent, to fulfill an order or respond to inquiries, or when legally required.
7. Online Store Offer
“NEW” label indicates a product newly added to the store; valid for up to 2 months from first listing.
“SALE” or “DISCOUNT” label marks products at reduced prices; the original price is shown alongside. Promotional terms and validity period are listed in the offer details.
8. Ordering via the Online Store
A sales contract is concluded when the Seller sends the Buyer an email confirming receipt of the order. From that point, prices and other terms become fixed and binding.
Buyer details:
- Name and surname
- Country
- Address, postal code, city
- Phone number
If the Buyer is a legal entity, company name and tax number must also be provided. Registered users can check their order status at any time.
The Seller reviews stock and confirms or rejects each order. If an item is unavailable, the order is canceled, and any prepayment is refunded. The Seller will inform the Buyer of estimated delivery times. If the Buyer no longer wishes to wait, they may email shop@tiga243.com to remove that item and receive a refund.
Withdrawal from part of an order does not affect the remainder, unless the Buyer explicitly withdraws from the entire order per their legal right of withdrawal.
The Seller is not liable for delays caused by stock shortages. Dispatched items are sent and the Buyer is informed by email, which reiterates the right of withdrawal, contact details for complaints, and procedures in case of delivery delays.
9. Payment
Card Payment: via Stripe—secure, no additional fees. Cards accepted: Mastercard, Visa, American Express. The Buyer remains on the bank’s secure payment page to enter card details and 3D-Secure code.
Bank Transfer: to account SI56 6100 0002 4053 437 (Tim Gajser s.p.). Orders via transfer are processed only after payment has cleared, which may add 1–2 days to delivery.
10. Prices
Prices are shown in EUR and include VAT unless stated otherwise. Delivery charges are added at checkout. Errors may occur; in such cases, the Buyer will be informed and offered a revised order or a full refund.
Discount Codes: time-limited, single-use. Cannot be combined. Cancelled orders do not reactivate a used code.
Gift Vouchers earn no interest and cannot be redeemed for cash.
11. Discount Code or Coupon
A discount code or coupon is time-limited and grants the customer various purchase benefits. The active code may be sent to the customer’s email address, published in media or advertising messages, or displayed on the seller’s website. Each coupon code may be used only once. If a customer applies a code to an order and then cancels that order, they are not entitled to reuse the code for a new benefit. To redeem a coupon, the customer enters the code in the shopping cart during checkout and clicks the “Redeem Coupon” button. The discount amount is automatically deducted from the order total, as shown in the summary. The customer must then pay any remaining balance indicated in the order summary. Combining multiple discounts (i.e., more than one code or coupon) in the same order is not permitted. The customer completes the purchase by clicking “Proceed to Checkout,” entering their personal details, selecting a payment method, accepting the Terms & Conditions and Privacy Policy, and then clicking “Buy Now.”
12. Delivery Costs
Delivery is handled by Pošta Slovenije or DPD, to the address provided at checkout. If an item is out of stock, the Seller may back-order it and deliver it later; partial deliveries are permitted. Shipping is free for orders over €100 (Slovenia), €150 (EU), or €200 (outside EU). Exact costs are shown before order confirmation.
13. Security
The Site uses 128-bit SSL encryption via Stripe. Users are responsible for keeping their login credentials secure. The Operator is not liable for damage due to insecure user systems.
14. Right of Withdrawal
Consumers (natural persons buying for non-business purposes) may withdraw from the contract within 14 days of receipt, without giving reasons. To do so, they must email shop@tiga243.com and submit the withdrawal form. The withdrawal period begins the day after delivery.
Returned goods must be shipped back at the consumer’s expense within 30 days of notification, unused, undamaged, in original packaging, with the form and a copy of the invoice. If the Buyer inspects the item beyond what is necessary to establish its nature, the consumer bears responsibility for any diminished value.
Exclusions from the right of withdrawal include:
- Custom-made goods
- Perishable or hygiene-sealed items once opened
- Sealed audio/video recordings or software once unsealed
- Newspapers/magazines (except subscriptions)
- Digital content delivered electronically once download has begun with user’s consent
Refunds are issued via the original payment method, minus any discounts. Voucher-based refunds are re-issued as vouchers.
15. Warranty
If a product carries a warranty (as stated on the warranty card or invoice), it is valid for the period and subject to the conditions on the warranty card, upon presentation of the invoice.
To claim warranty, the Buyer must email shop@tiga243.com with the completed warranty claim form and a copy of the invoice.
16. Material Defects
Material defects in a delivered item may be asserted by the consumer in accordance with the applicable provisions of the Consumer Protection Act. The consumer may exercise their rights for a material defect if they notify the seller of the defect within two (2) months from the date the defect was discovered. In the notification, the consumer must describe the defect in detail and allow the seller to inspect the item. The seller is not liable for material defects that become apparent more than two (2) years after the item was delivered. A defect is presumed to have existed at the time of delivery if it appears within six (6) months of delivery.
A consumer who has validly notified the seller of a defect has the right to demand that the seller:
Remedy the defect or return part of the purchase price in proportion to the defect;
or Replace the defective item with a new, non-defective one;
or Refund the full purchase price.
A defect is considered material if:
The item lacks the qualities necessary for its normal use or for trading;
The item lacks the qualities required for a special use for which the consumer purchased it, and of which the seller was or should have been aware;
The item lacks the qualities and characteristics expressly or implicitly agreed upon;
The item does not conform to the sample or model shown, unless the sample or model was displayed for illustrative purposes only.
The suitability of the item for normal use is assessed by comparison with ordinary goods of the same type and by taking into account any statements about its characteristics made by the seller or manufacturer, particularly in advertising, product descriptions, or labeling.
The consumer must notify the seller of any material defect within the prescribed period using the pre-printed claim form, providing a precise description of the defect, attaching a copy of the invoice, and granting the seller an opportunity to inspect the item.
17. User Obligations
Users must provide accurate data when ordering or registering. Unauthorized reproduction of Site content, logos, or trademarks (e.g., “tiga243” or “Tim Gajser s.p.”) is forbidden without written consent. Users may not use the service contrary to applicable laws or distribute copyrighted materials.
18. Communications & Marketing
The Operator may contact users only with their consent or to fulfill orders. Users may opt in to newsletters and promotions, and may unsubscribe at any time via shop@tiga243.com.
All marketing emails must be clearly marked, identify the sender, and specify conditions for participation in promotions. Unsubscribed users will not receive further promotional emails.

20. Intellectual Property
All Site content is protected under the Copyright and Related Rights Act. Unauthorized use will be prosecuted.
21. Liability Limitations
The Operator strives for uninterrupted service but may suspend access for maintenance. The Operator and its contractors are not liable for any damages or inconvenience resulting from downtime, technical issues, or use of the Site on inadequately protected user systems. 23. Site Availability & Termination
The Operator may disable the Site for technical or maintenance reasons and is not liable for any resulting costs or damages to users.
24. Final Provisions
The currently published Terms apply at www.tiga243.com and may be amended at any time. Continued use of the Site after changes implies acceptance. In case of disagreement with revised Terms, the user must immediately stop using the Site.
These Terms take effect on the date of publication. Any disputes will be settled amicably or, failing that, before the competent court in Maribor, Slovenia.
