General Terms and Conditions

The general terms and conditions of the online store determine the conditions for the sale and purchase of Tim Gajser s.p. products. The general terms and conditions of the Tim Gajser s.p. online store has been drawn up in accordance with the Consumer Protection Act (ZVPot) and international codes on e-commerce. The Tim Gajser s.p. online store is an ICT system intended for the presentation and sale of products to users. It is operated by Tim Gajser s.p., Cestarska pot 8A, SI-2313 Fram. A user is a person using our system, i.e. a customer of the Tim Gajser s.p. online store.

The mutual obligations between Tim Gajser s.p. and the user deriving from purchases in the Tim Gajser s.p. online store are governed by these general terms and conditions. Each user of the Tim Gajser s.p. online store is assigned a username and password to authenticate them. The password is secret and known only to the user who receives it by email. The user is solely responsible for the use of their account, the username and password are not transferrable and may be used only by a person authorised to represent the user.

These general terms and conditions apply to the services of the Tim Gajser s.p. online store, the user’s rights and the business relations between retailer and buyer.

Payment method

Credit card – The Tim Gajser s.p. online store allows you to pay for your order using secure online payment by credit/debit card. The card holder must be the person or organisation making the payment. When the card holder is not a citizen of Slovenia or when the payer and recipient are not the same person, we reserve the right to verify the identity of the payer and request the payer’s written consent to the payment of the relevant order, by email or fax. Once the order has been placed this payment method does not allow you to make changes to the contents of the order, the total for payment, the delivery address and other details.

All ordered items remain the property of Tim Gajser s.p. until they have been fully paid for. Orders become valid upon payment with one of the payment methods. In the case of non-payment or underpayment Tim Gajser s.p. reserves the right to request return of the items in their original condition.

The retailer issues a paper invoice that serves as written evidence in the case of complaints or returns.

Online prices

All prices are in EUR and inclusive of VAT. We reserve the right to change prices, if not stated otherwise (in case of special offers or discounts). The stated prices apply at the moment of order placement and their validity is not specified. The prices apply under the aforementioned payment methods and conditions. The stated prices apply to purchases made in the Tim Gajser s.p. online store and may differ from prices at other Tim Gajser s.p. points of sale.

Despite the retailer’s exceptional effort to provide the most up-to-date and accurate information, prices listed may not be accurate. In this case or in the case that the price of an item changes during the processing of an order, i.e. from the moment of submission of an order to the confirmation of the order, the retailer shall allow the user to withdraw from the purchase and offer a solution which will be to the benefit and satisfaction of both parties.

Validity of special offers

The terms of special offers may vary and are listed next to the special offer.

Withdrawal from purchase, return of items

The user has the right to withdraw from the transaction within 14 days of receiving the order by sending a notice of withdrawal to shop@tiga243.com. The user bears the direct cost of returning the items and must return them within 30 days of sending the notice of withdrawal. The returned items must be unused and in their original condition and packaging. The return shall be accompanied by a copy of the invoice. The retailer shall reimburse all payments received, including the costs of delivery, no later than within 15 days of receiving the notice of withdrawal.

Warranty

In the event of poor quality and faults please contact Tim Gajser s.p.’s quality control department at shop@tiga243.com. Faulty products shall be exchanged.

Items shall not be exchanged in the following cases:

· incorrect storage of the product,
· improper handling of the product,
· damage to product caused by the user or a third person.

Validation of the product shall be conducted by an expert group set by the manufacturer who will determine the admissibility of the complaint. For more information on Tim Gajser s.p.’s products contact shop@tiga243.com.

Delivery

The Tim Gajser s.p. online store aims to please all customers and delivers the ordered items to any address in the territory of the Republic of Slovenia within 5 working days. The delivery charge is specified in the order. Our carrier will contact you to arrange the exact delivery date and time. For deliveries to other countries the exact delivery date and time shall be communicated by our logistics operator. The shipping costs to other countries shall be specified in the order.

Deliveries take place on working days only.

If the buyer is not available to take delivery of the parcel, it may be accepted by a person of full age living in the same household as the buyer, or by another person authorised to accept the parcel. The person who takes delivery of the parcel confirms receipt of the parcel and accompanying documents by signing the delivery note and stating their name, surname, date of receipt and relationship with the buyer.

Security

The retailer uses appropriate technological and organisational means to protect the transfer and storage of personal data, as well as order and payment details. Tim Gajser s.p. is a bank certified retailer and uses Stripe, a secure interface to accept online payments. Stripe provides for the safe transmission of personal and financial data (debit and credit card numbers, payment methods) over the Internet. It uses a 128-bit SSL encryption protocol. It is the user’s responsibility to take all appropriate measures to protect access to their system and data, as well as their username and password. The user guarantees the veracity and accuracy of the data provided and shall be held responsible to Tim Gajser s.p. for any damages resulting from the provision of inaccurate or false data.

Privacy

The retailer undertakes to protect all personal data in accordance with the Personal Data Protection Act (OG RS no. 86/2004) and the Insurance Act. All the data obtained through the Tim Gajser s.p. online store shall be used exclusively for sending informational material, offers, invoices and other communication.

Communication

All monthly newsletters and advertising material via email must be clearly and unambiguously marked as such. The sender must be clearly identifiable. The retailer shall respect the user’s wish not to receive advertising or promotional material and monthly newsletters.

Disclaimer

The retailer shall to the best of its ability strive to maintain the currency and accuracy of the data published on its online store, however, the product characteristics, stocks and prices may change so quickly that the retailer is unable to update the data published on the online store on time. In such event the retailer will notify the user about such changes and allow them to cancel the order or exchange the ordered items. All product images are for illustrative purposes only and may differ from the actual product.

The retailer shall confirm receipt of the complaint within 5 working days and inform the user about the duration and course of the procedure. The retailer shall make every effort to resolve any disputes in an amicable way.
